1. General Rules

1.1 Who we are and application of these General Rules

1.1.1. 'BTSGuru' is the trading name of Beating The Spread Guru Pty Ltd (hereafter 'BTSGuru'), ABN 95 653 511 427, ACN 653 511 427, a company incorporated in Australia under the Corporations Act 2001 (Cth)('Corporations Act'). BTSGuru is an online based services company, providing Sport Betting information and selections in sports betting markets.

1.2 General

1.2.1 To open an account with BTSGuru ('Account') you must be aged 18 years or older and reside in Australia, New Zealand, The United States of America or Canada.  A 'Member' is a person who holds an Account, and any reference to 'you' or 'your' in these Rules is a reference to a Member.

1.2.2. You agree that the service offered by BTSGuru is the ability to review sports selections for purposes of betting.

1.2.3. By opening an Account, you are deemed to have read and accepted these Rules and BTSGuru's Privacy Policy. You can view the Privacy Policy on BTSGuru's website located at www.BTSGuru.com., any pages or websites under the 'BTSGuru' brand and any BTSGuru mobile phone or tablet applications that are owned and/or operated by BTSGuru ('Website') or by clicking here. 

The personal information (as defined by the Privacy Act 1988) of BTSGuru's customers may only be stored, accessed, used or disclosed offshore where such storage, access, use or disclosure is in accordance with all Australian laws, including the Privacy Act 1988, and BTSGuru's Privacy Policy.

1.2.4. BTSGuru reserves the right to change, amend or add to these Rules and the Privacy Policy at its discretion, and will publish such changes on the Website.  You agree that any changes, amendments or additions published on the Website will be taken to be effective immediately.  It is the Member's responsibility to ensure that they are aware of the terms and conditions and terms of use policies and Privacy Policy.

1.2.5.  You acknowledge and agree that by using, browsing or otherwise accessing BTSGuru's Website, including where your Account has been migrated to BTSGuru from a third party or related body corporate or where you remain a customer of one of BTSGuru's related bodies corporate (including BetEasy Pty Ltd) and use BTSGuru's platform to bet, you agree to be bound by these Rules, the Privacy Policy and any other applicable BTSGuru terms and conditions (‘Terms and Conditions’). 

BTSGuru may publish additional information or settlement rules in a ‘market blurb’ from time to time and, unless otherwise expressly stated, these will prevail to the extent of any inconsistency with these Rules or any other Terms and Conditions.  BTSGuru will use reasonable endeavours to notify Members of material changes in advance of those changes taking effect.

1.2.6. If you wish to become a registered user of BTSGuru's Website or app, you will need a user account which is recognised by BTSGuru, which may at our discretion include a user account migrated from third parties and related bodies corporate or an existing account we have approved for use on BTSGuru platform.

1.2.7. You agree that BTSGuru (or third parties authorised by BTSGuru) may send you direct marketing and promotional messages that are relevant to your relationship with BTSGuru.  These messages may be sent via different channels, including by email and SMS.  You may opt-out of receiving these messages (either altogether or via a particular channel) by updating your contact preferences in your Account, or by using any other unsubscribe facility we provide, in accordance with these Rules and any other applicable Terms and Conditions.

1.2.8. We may appoint an account representative to help manage your interactions with BTSGuru. Subject to your contact preferences, your account representative may communicate with you by email, SMS or phone.  Some of these messages may include marketing and promotional material.  However, given the personalised nature of these messages, you acknowledge and agree that they may not include an ‘unsubscribe’ or ‘stop’ mechanism.  If you wish to stop receiving these messages, you can opt-out or change your contact preferences at any time by replying to the message with the words 'OPT OUT' or otherwise informing your account representative. 

1.3 Member responsibilities 

1.3.1.  Members are responsible for ensuring that their Account details such as their address, telephone number, email address and payment/bank details (including any Debit card expiration details) are kept up to date and agree to notify us immediately of any incorrect Account details. In the event that a Member has not kept their Account details up to date, we reserve the right to suspend the Account. 

1.3.2. Members are advised that BTSGuru is not a betting site, nor a bookmaker and has duly informed the member that we do not accept bets or place bets for customers. 

1.3.3. Members are free to select and place bets with any licenced bookmaker they choose, no endorsement of or with is provided for any third party company. BTSGuru extends no condition for members accessing and using the service to require a betting account be opened. 

1.4. Member identification requirements

1.4.1. Members are required to provide BTSGuru with adequate information for the purposes of complying with the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) ('Act'). The Act provides for compliance obligations including collecting and verifying of Member’s identification information, with which BTSGuru is required to comply for the purposes of: (a) considering an application to open an Account; and (b) operating an Account including receiving payment for services rendered. 

1.4.2. At any time, including after an Account has been opened, BTSGuru reserves the right to request further information from Members to comply with the Act which includes (amongst other things) to further verify their identity, income or assets, source of funds (including origin or funds) and/or financial position. BTSGuru may suspend the Account and/or close the Account without prior notification to the Member, where the Member refuses or fails to respond to BTSGuru's request for Member’s information in order to comply with the Act.

1.4.3. As of 29 September 2023, BTSGuru is required by the Act to verify a Member's ‘identification information’ (‘ID’) (including your full name, residential address and date of birth) before they can transact on their Account. Members who do not provide full details up front may have their Accounts suspended, without notice, pending an investigation. If a Member's Account is opened but not verified, they will be unable to view any of the member services published on website, including new outcomes, or selections. 

1.4.4. By accepting these terms and conditions, the Member gives consent for BTSGuru to supply the Member's ID to a third party (e.g., Edentiti, GreenID etc.) to assist in verifying (or re-verifying, as applicable) the Member’s identity for the purposes of the Act. This may involve providing the Member’s details to a credit reporting agency to obtain an assessment of whether the personal information provided by the Member matches personal information contained in third party databases and/or credit headers. Identity verification is not a credit check, and no personal financial information is passed between third party ID verification providers and BTSGuru. The verification process available is not perfect and we cannot verify all Members in this way. This is not a fault of individual Members. If the Member does not wish to have their identity verified by a credit reporting agency, they should contact BTSGuru to discuss alternative avenues for identity verification. BTSGuru may also use other public information services to confirm a Member's identity.

1.4.5. BTSGuru may require proof of a Member's current address. If the Member's address is not on the front or back of one of the types of photographic identification referred to in Rule 1.4.7, the Member must provide proof of current address acceptable to BTSGuru. Acceptable proof of current address in such circumstances may include, at BTSGuru discretion, a certified copy (click here for more information)  of one or more of the following documents (which must be dated no more than 3 months prior to the date that the Member provides the document to BTSGuru):
a) a rates notice;
b) a utility bill.

1.4.6. All certified documents must be produced in the English language or they will be rejected. BTSGuru reserves the right to carry out checks on the individual certifying documents and to get in touch with them to verify the validity of the document. BTSGuru may in its discretion reject certified documents for any reason.

1.4.7. BTSGuru may at any time request acceptable photographic identification and proof of a Member's current address from a Member to ensure that all information supplied by the Member is up to date. This may require official certification of a Member's ID documents upon our request.

1.4.8. Should a Member deliberately falsify any ID or any other details for any purpose associated with applying for an Account or transacting on the Account, BTSGuru reserves the right to suspend the Account and/or close the Account without prior notification to the Member.

1.4.9. If a Prepaid/Virtual/Electronic/Travel/Debit card is to be used by a Member to fund the Account, legible copies of the front of the applicable card may be requested by BTSGuru at any time. BTSGuru reserves the right at its discretion to refuse to accept a Debit card including but not limited to in circumstances where the Debit card is dishonoured. Debit cards used to fund a Member's Account must match the Member's Account details. Debit cards with a name other than that which is registered with BTSGuru for the Account in question will be refused and the Account may be suspended until proof of consent is provided by the third party cardholder. Provision by the Member of a copy of the front of the card and/or third party consent does not guarantee activation/re-activation of the Account.

1.5. Account security

1.5.1.  A Member is responsible for ensuring that their user name and security details (including any personal identification number ('PIN'), password or Account number) ('Secure Member Details') are kept confidential. If a Member suspects that their Secure Member Details may no longer be confidential or that there may have been unauthorised use of their Account, they must notify BTSGuru immediately, and BTSGuru may provide the Member with new Secure Member Details. Where BTSGuru provides the Member with new Secure Member Details, BTSGuru reserves the right to invalidate any future transactions which attempt to utilise the previous Secure Member Details of that Member.

1.5.2. A Member is granted access to the system as a sole individual, and we do not accept sports clubs, syndicates or any other forms or groups to collectively participate, and or use the Services of a Members account. BTSGuru reserves the right to close or cancel a Member Account should they be found to be sharing Member content with any other person, or party.

1.5.3. Members sharing or distributing any BTSGuru Services content including new selections, outcomes or analytical content may be subject to damages and associated costs, along with the Account and Services behind suspended or cancelled. If BTSGuru is made aware of Members sharing our Member content without permission we may seek legal action against any Member and we may remove the Member without refund of service.

1.5.4.  If minors have access to a laptop or computer that a Member uses to log into their Account, BTSGuru strongly recommends that a child protection software package is installed onto that equipment. Two such software applications are Cyber Patrol and Net Nanny.

1.5.5.  BTSGuru's Website contains adult content and is intended for use by persons over the age of 18.

1.5.6. In order to use the BTSGuru App, your device location data from your device will be accessed and used by our integrated security systems to alert us to suspicious activity, for the purpose of protecting your account security and preventing fraud.

1.6. Payments, Coupons and Refunds

1.6.1. Payments for service terms into an Account can be made by means of Debit card, Credit Card, PayPal, Google Pay and Apple Pay.

1.6.2. BTSGuru reserves the right to remove or add payment options from time to time. Current available payment methods can be viewed within the 'My Account' section of our Website when you are logged in to your Account.

1.6.3. Members are not permitted to open more than one Account with BTSGuru (Supplementary Account(s)).  Where BTSGuru identifies that a Member holds a Supplementary Account , BTSGuru will close the Supplementary Account. Supplementary Accounts are in breach of BTSGuru's Rules.

1.6.4. Members Services are billed per service level as outlined within our Passes section or within the main shop of the website, Recurring Services are billed either Weekly, Monthly or Yearly as per the Members requested access to Service at the time of initial purchase. Weekly services are billed every Monday, Monthly Services are billed the 1st Day of each Month, ie 1st January, 2025, Yearly Services are billed the 1st of Day of each year from 1st January. All Services Pro Rate based on the total days left in the Service cycle.

1.6.5. Members provided with a coupon either directly from BTSGuru or from a BTSGuru Approved Affiliate, may use the Coupon at the initial time of purchase. After a first purchase has been made if a coupon was not used correctly or a coupon had expired a Member will not be entitled to a refund for the Coupon amount.

1.6.6. Members are advised that Coupons provided by a BTSGuru Approved Affiliate generally are included with a commission amount that is payable to the Authorised BTSGuru Approved Affiliate.

1.6.7. Members will only be entitled to a Refund for the period the current cycle they are being billed for and not for past services periods. A Weekly Member will be entitled to one week's refund only, a Monthly Member will be entitled to a one month's refund only to the value of the pass paid for; there is no refund past the first 30 days on a Yearly Pass, Once a Member has used the pass for 30 days there is no refund entitlement on the Yearly Passes. Any pro-rated pass paid for during the Pass Cycle is the total amount only to be refunded.

1.6.8. Should a Member for any reason request a refund and therefore closure of the Account, BTSGuru will place that Refund Request into the Account Settings, which will be reviewed and paid within a 5-7 working day period.

1.7. Chargebacks

1.7.1. Members agree and warrant that no chargebacks or other cancellation of deposits will be made relating to their Account without our consent (which will not be unreasonably withheld or delayed).  In the event that chargebacks or other cancellation of deposits are made to your Account without our consent, you agree to indemnify us for any costs, claims, damages and expenses relating to or arising in connection with this, including any expense incurred by us in recovering such amounts.

1.8 Fraud

1.8.1. BTSGuru reserves the right to withhold deposited funds and/or winnings from resulted bets should it determine that a Debit card has been misused or used fraudulently.  Any matters of inappropriate or fraudulent use of any Debit card will be reported to the relevant authority. The Member's Account may also be permanently closed.

1.8.2. BTSGuru may employ third party technologies to track and store technical information on the device that Members choose to use. Members accept that this data may be used to reach decisions on investigations where Accounts have not been operated in good faith, including but not limited to Account takeover, bonus or betting abuse, multiple Account operations, payment method abuse etc.

1.8.3.  BTSGuru reserves the right to close the Accounts of, and void any or all bets made by any person, group of people or corporation in an attempt to defraud BTSGuru.

1.8.4. BTSGuru may periodically review Accounts to monitor any activity that it might consider unusual. If unusual activity is detected, BTSGuru reserves the right to suspend an Account pending a full investigation, without notice.

1.9 Responsible Gambling

1.9.1. BTSGuru: informs Members of the risks involved in Sports Betting and Chances are you are about to Lose, 

(a) makes every reasonable effort to prevent self-excluded customers from returning and using our service;
(b) provides notices and links within the website to assistance by way of email, website links and phone numbers;
(c) advises all Members to conduct their own research and to use our tipping service as a guide;
(d) encourages Members to set a manageable Limit and or Limit on Unit amount that meets comfortably within their financial plan.

1.10. Affiliates

1.10.1. BTSGuru offers Affiliates a Service for introducing new Members to the BTSGuru Service;

1.10.2. BTSGuru Affiliates must apply to become an affiliate directly through the Members area of the site under the Affiliate Listing;

1.10.3. Affiliates must be at least 18 years of age;

1.10.4. Approved Affiliates will be provided with their own unique code that can be used on approved marketing material only;

1.10.5.. BTSGuru reserves the right to refuse any Affiliate for any reason;

1.10.6.. Approved Affiliates are compensated based on the agreed fees listed within the Affiliate section of the website;

1.10.7.. Affiliates will be compensated by way of a New Member signing up and using the Affiliates Coupon Code at the time of payment;

1.10.8.. Affiliates are compensated for the entire term of a Members Life so long as a Members Account is paid in full and active;

1.10.9.. Members requesting a refund of service will be refunded in full for the payment they have made, Affiliates if already paid at the time of refund to the Member will deducted the amount on the next pay cycle;

1.10.10.. Affiliates must maintain a bank account with the same name as listed in the Affiliate and Member Account.

1.11. Sports Betting Notices

1.11.1. BTSGuru is not a bookmaking agency or betting site. We do not accept bets or take money to wager or place bets for or on behalf of Members. We are not owned, operated or are a subsidiary of any betting agency, sportsbook or other gambling related company or website service of that nature;

1.11.2. BTSGuru is not affiliated with any betting agency or sports book and we do not endorse the services of any approved and licensed betting agency;

1.11.3. BTSGuru offers Members Service information and Sports Betting Guides including statistics, analysis of events, injury lists and other important information to provide the Member with information about outcomes in Sporting Events;

1.11.4. BTSGuru does not guarantee our predictions. We do not accept any liability for financial loss of any nature because of information including picks provided by BTSGuru;

1.11.5. BTSGuru does not accept any responsibility if you miss a selection or where not able to take utilise the information we provide;

1.11.6. BTSGuru advises that you should always gamble responsibly and bet within your limits, set a limit.

1.12. Sports Betting Agencies

1.12.1. BTSGuru is not a bookmaking agency or a betting site. We do not accept bets or take money to wager or place bets for or on behalf of Members;

1.12.2. BTSGuru is not owned, operated or is a subsidiary of any betting agency, sportsbook or other gambling related company or website service of that nature;

1.12.3. BTSGuru is not affiliated with any betting agency or sports book and we do not endorse the services of any licensed betting agency.

1.12.4. BTSGuru utilises API technology to display Sports Betting Markets from a variety of Sports Betting Agencies, we are not responsible for the accuracy of any of this data and you must refer to the Third Party Terms of Use Policies to agree to utilise this services.

1.13. Errors

1.13.1. BTSGuru endeavours to ensure that no errors are made in placing outcomes within our system or showing markets including but not limited to errors in prices offered, available selections offered, bets offered, by bookmakers who set the Markets. However, BTSGuru reserves the right to correct errors and to void any original selections prior to an event in circumstances where an outcome has been used and where there has been a material technical, human or other error in selecting an outcome or market.
